Wealth Preservation Planning, Part 2

Wealth preservation planning seeks to shield client assets from bankruptcy, the claims of creditors and others, and loss in litigation. It has become mainstream and uses a host of practical asset protection and estate planning techniques to achieve its objectives. This program will provide you with a guide to integrating those techniques in a comprehensive estate plan. Among other topics, the program will discuss the use of foreign and domestic trusts, the use of foreign and domestic insurance products, and exemption planning. The program will also discuss the risk of wealth preservation planning becoming the fraudulent transfer of assets and how to avoid that liability.

Day 1 – October 7, 2008:

· Overview of integration asset protection into estate planning

· Asset protection planning and avoiding of fraudulent transfers

· Forms of ownership as a protection tool – joint tenancy, tenancy in common

· Use of exemptions to protect assets

Day 2 – October 8, 2008:

· Gifting strategies

· Use of foreign and domestic trusts

· Domestic and foreign insurance techniques

· Expatriation of assets

· Protection of retirement benefits

Daniel S. Rubin is a partner in the New York office of Moses & Singer, LLP, where his practice concentrates on domestic and international estate and asset protection planning for high-net-worth individuals and their families. Additionally, he counsels clients on estate administrations and tax controversies, among many other matters. Mr. Rubin was recently recognized by Worth magazine as one of its “Top 100 Attorneys” in the nation for private clients and by Law & Politics magazine as a “New York Super Lawyer.” Mr. Rubin is a member of the Board of Directors of the Estate Planning Council of New York City and vice chair of the International Estate Planning Committee of the New York State Bar Association Trusts & Estates Law Section. He received his B.A. from George Washington University, his J.D. from Brooklyn Law School, and his LL.M. in taxation from New York University School of Law.
