Ethics in Digital Communications

The way in which lawyers do their work and communicate with their clients has been forever changed by technology. The technology lawyers use as a matter of course – Blackberries and wireless networks, application sharing and working from virtual offices – raise significant ethical issues. All information is now digital. It is easily converted to various formats and exchanged instantly, and sometimes accidentally. This program will provide you with a discussion of often overlooked ethical issues in using increasingly popular forms of technology in law practice.

Speaker:

Browning E. Marean, III, is a senior counsel in the San Diego office of DLA Piper, LLP, where he is co-chair of the firm’s Electronic Discovery Readiness and Response Group. He concentrates his practice in the areas of business litigation, technology matters, professional responsibility and knowledge management. Mr. Marean is a nationally known teacher and lecturer on various topics including electronic discovery, records retention, knowledge management and computer technology. He is co-author of the 2008 edition of Electronic Discovery and Records Management Guide, Rules, Checklists and Forms, published by Thomson West, and Conducting Discovery in an Electronic World: Electronic Data and Discovery, published by California Civil Discovery Practice. He received his A.B. from Stanford University and his J.D. from the University of California, Hastings College of Law.
