2010 Ethics in Civil Litigation, Part 2
This annual program will provide you with a review of significant ethical developments and issues affecting your civil litigation practice. Ranging from pre-trial investigations and preparing witnesses for deposition and trial to conflicts of interest, this program will provide you with a real-world guide to issues that have the most potential to give rise to ethical liability and negatively impact the underlying case. The program will also discuss the substantial ethical issues in working in an increasingly digital world where information is created, stored and transmitted electronically, often with unexplored ethical consequences.
Day 1 – June 1, 2010:
- Developments in conflicts of interest
- Ethics of preparing witnesses for deposition and trial, including posting witness videos to YouTube
- Ethical issues in digital communications
Day 2 – June 2, 2010:
- Ethical issues in e-discovery, including the creation and use of metadata
- Attorney/client privilege in a digital world, including disqualification issues
- Ethics in pre-trial investigations
Speakers:
Lucian T. Pera is a partner in the Memphis office of Adams & Reese, LLP. His practice includes professional malpractice litigation as well as counseling lawyers and law firms in the area of ethics and professional responsibility. He was a member of the ABA’s Ethics 2000 Commission and is co-author of "Ethics and Lawyering Today," a national e-mail newsletter on lawyer ethics, which is accessible at: www.ethicsandlawyering.com. Before entering private practice, he served as a judicial clerk to Judge Harry W. Wellford of the U.S. Court of Appeals for the Sixth Circuit. Mr. Pera received his A.B. with honors from Princeton University and his J.D. from Vanderbilt University School of Law.
Douglas Richmond is Senior Vice President in the Professional Services Group of AON Risk Services, where he consults with the company’s law firm clients on professional responsibility and liability issues. He is a member of the American Law Institute, the American Board of Trial Advocates, the International Association of Defense Counsel, and the Federation of Defense and Corporate Counsel. Mr. Richmond teaches legal ethics at the Northwestern University School of Law and he is a regular instructor at the National Institute of Trial Advocacy. Mr. Richmond received his B.S. from Fort Hays State University, his M. Ed. from the University of Nebraska, and his J.D. from the University of Kansas.
Michael E. Lackey is a partner in the Washington, D.C. office of Mayer Brown, LLP, where he has an extensive litigation practice representing companies and individuals in federal court and has developed a specialty in advising clients on a wide range of e-discovery issues. He is an advisory board member of the Georgetown University Law Center Advanced E-Discovery Institute and serves as an Adjunct Professor of Law at George Washington University Law School. Earlier in his career he served as a judicial clerk to Judge Jacques L. Wiener, Jr. of the U.S. Court of Appeals for the Fifth Circuit. Mr. Lackey received his B.S. from the Massachusetts Institute of Technology and his J.D. from the George Washington Law School.
